We are happy to represent people on either a private or legally aided basis in circumstances where they may be eligible.
 
We provide the same service to our Clients whether they are privately funded or legally aided. We have set out below some basic information about Legal Aid. Feel free to call us and we will happily undertake a basic means assesment over the telephone with you to determine if you might pass the Means Test part of the Legal Aid Application.

If you are unable to qualify for Legal Aid then we are happy to we represent you privately and will strive to agree a fixed fee structure so that you so that you know from the outset what your financial liabilities to the firm will be at each stage of the proceedings.

 

Legal Aid at the Police Station

Legal advice from a solicitor of your choice is free at the police station. A police officer must telephone your solicitor to tell him or her that you have been arrested, and they can attend at the Government’s expense.

Legal Aid in the Magistrates Court

In the Magistrates Court, there is a two-stage test for whether a person qualifies for Legal Aid. Both stages must be passed, or Legal Aid will not be given.

The Interests of Justice Test

The first is called the ‘Interests of Justice’ test. To pass this stage of the test, a Defendant must show that he or she is genuinely in need of legal advice.

The Means Test

The second stage of the two-stage test for Legal Aid is the means test and is dependant on the level of your disposable income.

People in custody will usually pass the means test.

 

How Crown Court Legal Aid Funding Works

Once a case reaches the Crown Court, Legal Aid is generally available for those who qualify under the means test. However, where a Defendant has above average income or substantial assets, the Legal Services Commission will usually make an order that the defendant make a contribution to his or her legal aid.
 
In some cases the Contribution can exceed the fee that we would charge you if you were paying privately which is why this means that it is sometimes in your best interests NOT TO apply for legal aid. it is vital that you contact us as soon as possible to discuss how your case can be funded.
